Ordinance No. 15,326 ORDINANCE NO. 15,326 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE CODE OF ORDINANCES, BAYTOWN, TEXAS, SUBPART A "GENERAL ORDINANCES," CHAPTER 109, " ENGINEERING AND CONSTRUCTION STANDARDS," ARTICLE III, "STREETS," REVISING SECTION 109.76, "GEOMETRICS STANDARDS," DELETING AND REPLACING THE TEXT OF SECTION 109.77, "STREETLIGHTS;" PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 109-76, "Geometric standards," of Article III, "Streets" of Chapter 109, "Engineering and Construction Standards" of Subpart A, "General Ordinances," of the Code of Ordinances, Baytown,Texas,is amended by revising the text and adding subparagraph 109-76(e), "Right-of-way layouts," to read as follows: Sec.109-76. Geometric standards. (a) Roadway material and subgrade designs shall conform to city standard details. (b) Roadways shall have the following design. characteristics: ROW width Street Median Minimum Maximum Transverse runningwidth width slope running slope slope Local/Residential 54 feet 30 feet 0 feet 0.33% 5.0% Collector 100 feet 64 feet 16 feet 0.25% Arterial 120 feet 88 feet 40 feet (c) Curves. (1) Horizontal curves. Except as provided for in this subparagraph 109-76(c)(1), the following minimum horizontal curves shall be met. a. Local streets shall have a minimum centerline radius of 300 feet. Under no circumstance shall a local street have a centerline radius of less than 150 feet. b. Collector streets shall have a minimum centerline radius of 800 feet. c. Arterial streets shall have a minimum centerline radius of 2,000 feet. d. The horizontal sight line offset shall be determined using the methods described in the AASHTO publication, A Policy on Geometric Design of Highways and Streets, as amended. The HSO shall be kept clear of all visual obstructions more than 42 inches above the surface of the roadway. C. A variance request to any requirement under this subsection (c), may be made to the Commission. If the Commission finds that the horizonal curves required under this subsection provide a hardship and the spirt and intent of this ordinance can still be met, the Commission may grant a variance from the requirements under this subsection. (2) Reverse curves are to be separated by a minimum tangent of 100 feet. (3) A vertical curve design is required when the algebraic difference in grade exceeds one percent. (d) Intersections. (1) The intersection of a public or private roadway with a public or private roadway shall intersect at 90-degree angles. (2) The intersection of a driveway with a public or private roadway shall intersect at 90- degree angles. (3) A variance request to requirements under this subsection (d), may be made to the director. If the director finds that the curves required under this section provide a hardship and the spirt and intent of this ordinance can be met, and intersections do not skew more than 15 degrees from perpendicular, the director may grant a variance from the requirements under this subparagraph 109-76(d)(2) and (3). (4) A sight triangle shall be developed for the intersection of all private or public connection access points to all private or public roadways. a. The development of each sight triangle shall follow the methodologies presented in the AASHTO publication A Policy on Geometric Design of Highways and Streets, as amended. b. Sight triangles shall be kept clear of all visual obstructions greater than 42 inches above the roadway surface unless approved by the director. (e) Right-of-way layouts. (1) Acquisitions, classifications or dedications for local streets must be a minimum 54-foot wide right-of-way and developed with a minimum of one 15-foot lane in each direction and a five-foot sidewalk adjacent to the street on both sides, as illustrated in Illustration 109-76(e)(1) below, and in continuity with any connecting right-of-way(s), as interpreted by the director. 2 Illustration 109-76(e)(1) 54 ft 5 ft 15 ft 15 ft 5 ft CO N a Cn 3ft 4ft 4ft 3ft (2) Acquisitions, classifications or dedications for collector streets must be a minimum 100- foot wide right-of-way and developed with a minimum of two 12-foot lanes in each direction, a 16-foot wide median separating the two lanes, a five-foot sidewalk adjacent on one side of the street and a 10-foot path adjacent to the opposite side of the street, as illustrated in Illustration 109- 76(e)(2) below, and in continuity with any connecting right-of-way(s), as interpreted by the director. Illustration 109-76(e)(z) 100 ft 010 12ft 12ft 12ftMoo 5ft 16ft (3) Acquisitions, classifications or dedications as arterial streets and higher must be a minimum 120-foot right-of-way and developed with a minimum of two 12-foot lanes in each direction, a 40- foot median or a 16-foot median if developed with three 12-foot lanes in each direction, a five- foot sidewalk adjacent to the road on one side and a 10-foot path on the opposite side of the street, as illustrated in Illustration 109-76(e)(3) below, and in continuity with any connecting right-of- way(s), as interpreted by the director. 3 120 ft Illustration 109-76(e)(3) loft 12ft 12ft 12ft 16ft 12ft 12ft 12ft 5 aft 5ft 40ft 5ft 4ft Section 2: That Article III, "Streets," of Chapter 109, Engineering and Construction Standards" of Subpart A, "General Ordinances," of the Code of Ordinances, Baytown, Texas, is amended by deleting the text of Section 109-77, "Streetlights," and replacing it with the text and table as follows: Sec. 109-77. Streetlights. Each right-of-way developed under this chapter must be improved and maintained with streetlights in accordance with this section. (1) The installation and cost of materials, installation and electric service is the responsibility of the person or entity responsible under the laws of the City of Baytown for the right-of-way being improved. If the City of Baytown accepts the improved right-of-way, the cost of maintaining and electric service will be borne by the City of Baytown. (2) Streetlights shall be installed and maintained as follows: (a) Except for the luminaires portion of the streetlight, the exterior portion of the streetlight, including the pole, must be powder-coated black. (b) Luminaires shall be 250W equivalent LED. (c) Streetlight poles shall follow the guidelines presented in the City of Baytown Roadway Illumination Standards. (d) Spacing and number of streetlights must ensure the illumination levels needed for the type of roadway, adjacent land uses, and aesthetics of the surrounding area to be served and must be no lower than the foot-candle values in the table below. If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional,void,or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances; and to this end, all provisions of this ordinance are declared to be severable. Section 4. This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
