AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE FINAL PAYMENT UNDER A
DEVELOPMENT AGREEMENT TO D.R. HORTON, INC., IN THE AMOUNT
OF ONE HUNDRED FIFTY-SEVEN THOUSAND EIGHT HUNDRED,
EIGHTY-EIGHT AND NO1100 DOLLARS ($157,888.00) FOR THE CITY'S
PORTION FOR THE ADDITION OF A TRAFFIC SIGNAL AT COUNTRY
CLUB DRIVE AND WEST BAKER ROAD; MAKING OTHER PROVISIONS
RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, on December 10, 2015, the City Council of the City of Baytown, Texas,
passed Ordinance No. 13,056 authorizing a Development Agreement with D.R. Horton, Inc., for
certain roadway and infrastructurc improvements associated with Goose Creek Reserve; and
WHEREAS, Ordinance No. 13,056 authorizes payment pursuant to the Agreement in an
amount not to exceed ONE HUNDRED SIXTY THOUSAND AND NO/100 DOLLARS
($160,000.00); and
WHEREAS, the Agreement included a clause under which the City is to pay 50% of the
final construction cost for a traffic signal at Country Club Drive and West Baker Road; and
WHEREAS, the total final construction cost is THREE HUNDRED FIFTEEN
THOUSAND SEVEN HUNDRED SEVENTY-SIX AND NO/100 DOLLARS ($315,776.00);
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council hereby finds and determines that construction of a
traffic signal at Country Club Drive and West Balser Road has been completed as required under
the Development Agreement and in full accordance with all of the terms and provisions of the
aforesaid contract.
Section 2: That the total final construction cost for the traffic signal at Country Club
Drive and West Baker Road is THREE HUNDRED FIFTEEN THOUSAND SEVEN HUNDRED
SEVENTY-SIX AND NO1100 DOLLARS ($315,776.00).
Section 3: That final payment to D.R. HORTON, INC., in the amount of ONE
HUNDRED FIFTY-SEVEN THOUSAND EIGHT HUNDRED, EIGHTY-EIGHT AND NOI100
DOLLARS ($157,888.00) is hereby authorized.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
