Ordinance No. 15,226 ORDINANCE NO. 15,226 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING ORDINANCE NO. 14,852, WHICH AUTHORIZED THE PURCHASE OF SIX(6) FORD F-150 CREW CABS; THIRTEEN(13) F-250 CREW CABS; ONE(1)F-350 REGULAR CAB; AND ONE (1) F-350 CREW CAB, FOR A TOTAL OF TWENTY-ONE (21) FORD TRUCKS, FROM SILSBEE FORD, THROUGH GOODBUY PURCHASING COOPERATIVE IN THE AMOUNT OF SEVEN HUNDRED TWENTY-FIVE THOUSAND ONE HUNDRED TWENTY AND 50 100 DOLLARS ($725,120.50) FOR THE PUBLIC WORKS AND ENGINEERING DEPARTMENT AND THE PLANNING AND DEVELOPMENT SERVICES DEPARTMENT; AUTHORIZING PAYMENT OF AN AMOUNT NOT TO EXCEED FOUR HUNDRED EIGHTY-ONE THOUSAND SIXTY-FOUR AND 25/100 DOLLARS ($481,064.25) TO SILSBEE FORD INC., THROUGH GOODBUY PURCHASING COOPERATIVE, FOR THE PURCHASE OF TWELVE (12) F-250 CREW CABS; ONE (1) F-350 REGULAR CAB; AND ONE (1) F- 350 CREW CAB FOR THE PUBLIC WORKS.ENGINEERING DEPARTMENT; AUTHORIZING PAYMENT OF AN AMOUNT NOT TO EXCEED TWO HUNDRED SEVENTY-NINE THOUSAND THIRTY-NINE AND 48/100 DOLLARS ($279,039.48) TO FRIENDLY FORD FOR THE PURCHASE OF SIX (6) FORD F-150 CREW CABS; AUTHORIZING PAYMENT OF AN AMOUNT NOT TO EXCEED FORTY-SEVEN THOUSAND FIVE HUNDRED SIXTEEN AND 67 100 DOLLARS ($47,516.67) TO BAYTOWN FORD FOR THE PURCHASE OF ONE (1) F-150 CREW CAB; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ********************************************************************************** WHEREAS, the City of Baytown is a member of the cooperative purchasing program established under Sections 271.082 and 271.083 of the Texas Local Government Code; and WHEREAS, the GoodBuy Purchasing Cooperative Program is such a program, allowing municipalities to purchase products and/or services in an efficient, cost effective, and competitive procurement method; and WHEREAS, the City of Baytown, in making a purchase under a state contract through such cooperative purchasing program, satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; and WHEREAS, Ordinance No. 14,852 authorized the purchase of six (6) Ford F-150 Crew Cabs; thirteen (13) F-250 Crew Cabs; one (1) F-350 Regular Cab; and one (1) F-350 Crew Cab, for a total of twenty-one (21) Ford trucks from Silsbee Ford, through GoodBuy Purchasing Cooperative in the amount of SEVEN HUNDRED TWENTY-FIVE THOUSAND ONE HUNDRED TWENTY AND 50/100 DOLLARS ($725,120.50) for the Public Works and Engineering Department and the Planning and Development Services Department; and WHEREAS, Ordinance No. 14,852 incorrectly authorized the purchase of six (6) F-150 Crew Cabs and thirteen(13)F-250 Crew Cabs and should have instead authorized the purchase of seven(7)F-150 Crew Cabs and twelve (12) F-250 Crew Cabs; and WHEREAS, due to continued supply chain issues resulting from the pandemic, at this time,the City has been unable to procure the desired amount of Ford trucks as authorized by Ordinance No. 14,852; and WHEREAS, Silsbee Ford can accommodate the purchase of twelve (12) F-250 Crew Cabs; one (1) F-350 Regular Cab; and one (1)F-350 Crew Cab by January 2023; and WHEREAS, two local Ford dealerships can at this time accommodate the purchase of seven (7) F- 150 Crew Cabs; and WHEREAS, currently, Friendly Ford in Crosby can accommodate six (6) of the F-150 Crew Cabs, while Baytown Ford can provide one (1)of the F-150 Crew Cabs; and WHEREAS,the cost of each of the seven(7)F-150 trucks has increased by approximately TWELVE THOUSAND AND NO1100 DOLLARS ($12,000.00) per unit, for an increased amount not to exceed EIGHTY-TWO THOUSAND FOUR HUNDRED NINETY-NINE AND 90 100 DOLLARS ($82,499.90), bringing the new overall total for all twenty-one(2 1)vehicles to an amount not to exceed$807,620.40;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby repeals Ordinance No. 14,852, adopted on September 23, 2021, which authorized the purchase of six (6) Ford F-150 Crew Cabs; thirteen (13) F-250 Crew Cabs; one (1) F-350 Regular Cab; and one (1) F-350 Crew Cab, for a total of twenty-one (21) Ford trucks from Silsbee Ford, through GoodBuy Purchasing Cooperative in the amount of SEVEN HUNDRED TWENTY-FIVE THOUSAND ONE HUNDRED TWENTY AND 50/100 DOLLARS ($725,120.50) for the Public Works and Engineering Department and the Planning and Development Services Department. Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes payment of an amount not to exceed FOUR HUNDRED EIGHTY-ONE THOUSAND SIXTY-FOUR AND 25/100 DOLLARS ($481,064.25) to Silsbee Ford Inc., through Goodbuy Purchasing Cooperative, for the purchase of twelve (12) F-250 Crew Cabs; one (1) F-350 Regular Cab; and one (1) F-350 Crew Cab for the Public Works/Engineering Department. Section 3: That the City Council of the City of Baytown, Texas, hereby authorizes payment of an amount not to exceed TWO HUNDRED SEVENTY-NINE THOUSAND THIRTY-NINE AND 48/100 DOLLARS ($279,039.48) to Friendly Ford for the purchase of six (6) Ford F-150 Crew Cabs. Section 4: That the City Council of the City of Baytown, Texas, hereby authorizes payment of an amount not to exceed FORTY-SEVEN THOUSAND FIVE HUNDRED SIXTEEN AND 67!100 DOLLARS ($47,516.67) to Baytown Ford for the purchase of one (1) Ford F-150 Crew Cab. Section 5: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NOI100 DOLLARS ($50,000.00) or less,provided that the original contract price may not be increased by more than twenty-five percent(25%) or decreased by more than twenty-five percent(250,"0)without the consent of the contractor to such decrease.
