2022 05 24 BPAC Minutes MINUTES OF THE MEETING OF THE BAYTOWN POLICE ADVISORY COMMITTEE OF THE CITY OF BAYTOWN May 24, 2022 The Baytown Police Advisory Committee (BPAC) met in a Meeting on Tuesday, May 24, 2022, at 6:02 P.M. in the Council Chamber of the Baytown City Hall, located at 2401 Market Street, Baytown, Texas with the following in attendance: Yulanda Braxton Committee Member Lt. Rodney Evans Committee Member Dr. Marissa Moreno Vice Chairperson Dr. June Stansky Committee Member Richard Hunsinger Committee Member Cpl. Steve Ocanas Committee Member Eric Bolenbaucher Chairperson Angela Jackson Assistant Secretary John Stringer Police Chief Jerris Mapes Legal Counsel Chairperson Eric Bolenbaucher convened the May 24,2022, Baytown Police Advisory Committee (BPAC)Meeting with a quorum present at 6:02 P.M., all members were present with the exception of Committee Member Dr. June Stansky, who arrived at 6:20 P.M. 1. MINUTES a. Consider approving the minutes of the Baytown Police Advisory Committee Meeting held on April 26, 2022. A motion was made by Committee Member Richard Hunsinger and seconded by Vice Chairperson Dr. Marissa Moreno to approve the meeting minutes of the Baytown Police Advisory Committee Meeting held on April 26, 2022, as submitted. The vote was as follows: Ayes: Chairperson Eric Bolenbaucher, Committee Member Yulanda Braxton, Committee Member Lt. Rodney Evans, Vice Chairperson Dr. Marissa Moreno, Committee Member Richard Hunsinger, and Committee Member Cpl. Steve Ocanas Nays: None Other: Committee Member Dr. June Stansky(Absent) Approved Baytown Police Advisory Committee Meeting Minutes May 24,2022 Page 2 of 6 2. CITIZEN INPUT a. Receive citizen input concerning police outreach, community policing, officer training, as well as policies and procedures. Chairperson Bolenbaucher announced that no one signed up to speak on agenda item 2.a and encouraged the public to provide their input. 3. BUSINESS ITEMS a. Discuss and consider the presentation of the Baytown Police Advisory Committee's quarterly report to the City Council on May 26, 2022. Chairperson Eric Bolenbaucher presented an overview of the Quarterly Report that was to be presented to Council at their May 26, 2022 meeting, and stated that the following items were the focus of the report: • Committee Members: Introduction of the Committee Members with their titles, as well as announce any vacancies on the Board, which is for District 6 and the Mayor at Large position. • Committee Focus: Overview of the Committee, its duties, focus and authority. • Community Outreach: Discussed what the Committee is doing to garner input from the Community to see if there are any issues from various areas. • Acknowledgement: Acknowledge the input from Chief Stringer for addressing the cultural diversity and the concerns of the community, as well as the Committee Members. • Questions: Entertain Council and the Audience with any questions,comments,or concerns regarding the presentation. Furthermore, Chairperson Bolenbaucher also noted that he would like to inform Council of the need to fill the vacancies on the Board since this creates an issue with maintaining the required quorum to conduct meetings. Vice Chairperson Dr. Marissa Moreno asked how many meetings the Committee was not able to hold due to the lack of quorum and Deputy Assistant Secretary Raquel Martinez replied two—one in January and one in February. Committee Member Yulanda Braxton requested clarification of the Committee's authority and Chairperson Bolenbaucher explained that policy and procedures are regulated by the Legislator and the Texas Commission of Law Enforcement, and that the Committee has no authority to make policy changes, but they can gather information, and present the said information to Council to request changes. Furthermore, Ms. Braxton requested clarification on the proper protocol in the event a Committee Member were to be approached by a Citizen with a concern. Chairperson Bolenbaucher replied that he believed the best course of action would be to request the citizens to be a part of their meeting, so that it can be presented to the Committee as a whole, and if the citizen could not attend, the Committee Member could represent the information on their behalf. Baytown Police Advisory Committee Meeting Minutes May 24, 2022 Page 3 of 6 Legal Counsel Jerris Mapes and Police Chief John Stringer both noted the importance of the flow of communication and feedback from the public and encouraged not only items of concern, but also positive input,and ideas as well.Vice Chairperson Dr. Moreno questioned how the Committee could facilitate bringing one of these items before the Committee and Ms. Mapes replied Staff could add a new agenda item titled "Community Input"to the next agenda item so that Committee can receive and discuss any public input that the was obtained by the Committee Members. Chairperson Bolenbaucher inquired for further questions from the Committee and encouraged the Committee Members to be present for the presentation on May 26th, 2022. With there being no further questions Mr. Bolenbaucher called for a motion to accept the report as presented. A motion was made by Committee Member Richard Hunsinger and seconded by Committee Member Lt. Rodney Evans to approve the presentation of the Baytown Police Advisory Committee's Quarterly Report to the City Council on May 26, 2022. The vote was as follows: Ayes: Chairperson Eric Bolenbaucher, Committee Member Yulanda Braxton, Committee Member Lt. Rodney Evans, Vice Chairperson Dr. Marissa Moreno, Committee Member Richard Hunsinger, and Committee Member Cpl. Steve Ocanas Nays: None Other: Committee Member Dr. June Stansky (Absent) Approved b. Consider setting any tasks and processes for future meetings, to include: a. Community Engagement Initiatives; b. Recording a BPAC public service announcement to be advertised on Channel 16 and social media; c. Seek clarification or direction for the Committee's purpose and/or mission; and d. Creation of an election policy to be reviewed at a future meeting. Community Engagement Initiatives: Chairperson Eric Bolenbaucher opened the agenda item and provided the Committee a brief overview of the Committee's Engagement Initiatives and turned the platform to Vice Chairperson Dr. Marissa Moreno to discuss possibly using Tucker Hall at Lee College as a venue for a future meeting, as she believed the college would be the most opportune place to garner public input. The Committee discussed the cost to rent the facility and potential upcoming dates of June 21 st or June 28th Chairperson Bolenbaucher then inquired if the Committee Members were in favor of trying to move forward with the committee getting out into the community and the Committee agreed. Vice Chairperson Dr. Moreno noted that she did not want to dismiss what Lieutenant Rene Hinojosa mentioned previously about the possibility of his group conducting a formal meeting with the Community and Legal Counsel. Ms. Mapes responded that they were not ready to hold a formal meeting with the community on their own at this point. Baytown Police Advisory Committee Meeting Minutes May 24,2022 Page 4 of 6 In conclusion Chairperson Bolenbaucher polled all of the Committee Members to get their consensus on holding future meetings at a different location other than the Baytown Council Chamber and all the Committee Members were in agreement. Public Service Announcement: Chairperson Eric Bolenbaucher discussed the use of a Public Service Announcement to be advertised on Channel 16 and Social Media and asked the Committee if they would be interested in being a part of the service announcement. Chairperson Bolenbaucher polled all of the Committee Members to get their consensus to record a Public Service Announcement to help the Committee meet their objective to gathering as much public input as possible, and all Committee Members were in agreement. Committee's Purpose and Mission: Legal Counsel Jerris Mapes presented the Committee with the duties that were established with the original passage of the Committee, which were outlined in Resolution No. 2674, Section 2(e), and recommended that the Committee incorporate this, or portions thereof, into the Mission Statement: Resolution No. 2674, Section 2(e): Powers and duties. The Baytown Police Advisory Committee shall hold such public forums to receive input from diverse community groups to enhance understanding through communication and education, to improve and maintain the public trust of the Baytown Police Department, and to further the purpose of the Committee Furthermore, Legal Counsel Ms. Mapes recommended that the Committee Members bring their ideas and suggestions on a Mission Statement at their next meeting, so that the Committee can bring them all together and discuss them as a whole. Chairperson Eric Bolenbaucher concurred with Ms. Mapes' recommendation. Creation of an Election Policy: Legal Counsel Jerris Mapes provided an overview of the agenda item and stated that this item is to discuss the Creation of the Election Policy and that action would be diverted to the next meeting. She further provided an overview of a draft for the Election Policy and pointed out the following items: a. Current Presiding Officer is to take over the current meeting and the newly elected Presiding Officer will take over at the next meeting b. Discussing how nominations would be received and the draft as presented suggests that nominations be made for both positions, including self-nominations, be made electronic via email prior to the meeting, or orally at the meeting when nominations are requested, but prior to the election. And to clarify that all nominations will be declared openly prior to the election, therefore, nominations must be concluded before any balloting begins. Candidates may make a statement to the Committee regarding their candidature and that the statement shall be limited to five minutes. d. This item states that the office of Chairperson will be elected by ballot stating the candidate's name and that after the votes are counted, the candidate who receives the majority of the votes is elected. Any candidate who fails to be elected for a position may be nominated for a subsequent position. f. If in the event two or more candidates are running and neither receive a majority of votes, the vote is rerun and only the candidates receiving the top two highest vote count. If the vote is retaken, and then if you do this twice, and then you have a tie,the suggested for that would be a coin toss to choose which candidate is elected. Having presented the proposed changes Legal Counsel Ms. Mapes opened the floor to any questions from the Committee and Vice Chairperson Dr. Marissa Moreno questioned the possibility if there was a tie that the Chairperson's vote would not be counted in the event of a tie and Ms. Mapes said that was up to the Committee and she can present this for discussion at the next meeting. Furthermore, Vice Chairperson Dr. Moreno questioned how other Committees handles the election process and Ms. Mapes responded that the majority of them make a verbal nomination and then it is followed by a vote. Committee Member Richard Hunsinger noted his concern of removing the Chairperson's vote and Ms. Mapes suggested that the Committee think about it and bring their thoughts at the next meeting. Chairperson Eric Bolenbaucher made a motion to bring the item at their next meeting and the consensus from all of the members was that that they were all in agreement. 4. NEXT MEETING a. Consider setting date, time and location for the next Baytown Police Advisory Committee meeting, along with any related tasks and processes. Chairperson Bolenbaucher concluded that the Community Input item was being added to the next agenda and requested that Staff email the Rules of Procedure to the Committee for their review. Furthermore, Mr. Bolenbaucher requested a consensus to change the next meeting date from June 28, 2022, to June 21, 2022. All Committee Members were in agreement with the meeting date change to June 21, 2022. Legal Counsel Jerris Mapes provided the Committee with the guidelines in regards to quorum of the members at social events and etc., that they are not to discuss city business, as it would violate the Texas Open Meetings Act, and the same applies to emails as well. Lastly, Ms. Mapes mentioned that National Night Out will have an event in in the upcoming months and suggested the possibility of the Committee having a booth at the event. She further noted that this would have to be discussed amongst the Committee in an open forum, but something worth noting if the interest was there. ADJOURN With there being no further business to discuss, a motion was made by Vice Chairperson Dr. Marissa Moreno and seconded by Committee Member Lt. Rodney Evans to adjourn the May 24, 2022, Baytown Police Advisory Committee Meeting at 7:15 P.M.
